Ken has a wide-range of experience in both trial and appellate courts with particular expertise in representing both banks and CMBS loan servicers in the enforcement of commercial mortgage loans. This work with securitized loan servicers includes commercial mortgage foreclosures and related loan workouts as well as enforcement of the rights of securitized trusts under Pooling and Servicing Agreements and Mortgage Loan Purchase Agreements. Ken is also experienced in numerous other types of litigation including simple and complex contract disputes, commercial landlord–tenant disputes and corporate dissolution and derivative actions. Ken has handled matters in both state and federal courts as well as in mediations and arbitrations. A significant amount of Ken's practice has focused on bankruptcy–related matters. Ken has represented numerous creditors in courts throughout the United States and in Canada, including Bankruptcy Courts located in New York, New Jersey, Connecticut, Delaware, Missouri and California. Most recently, Ken has appeared on behalf of secured creditors in the General Growth Bankruptcy, the American Home Mortgage Bankruptcy and various bankruptcies involving single asset real estate entities. Ken also has transactional experience and has represented both buyers and sellers of real property and businesses. In addition to the transactional work, Ken advises several of the firm's corporate clients on various matters involving their business, including employment issues, shareholder matters and negotiations with vendors and suppliers. Ken, his wife Sonia, their three children and their boxer, Jager, live in Scarsdale, New York. Ken is a founding member and president of the Down Syndrome Association of Westchester, Inc. Ken is also on the Board of Directors of the Hunter Mountain Racing Foundation.
